Reader’s Question:

My drivers license has been suspended In Florida for thirty days because I accumulated more than 10 points in a year. Do I need to get an SR22 for this?

Sam

Clearwater FL
You might have to get SR-22 to to have your driver’s license reinstated in Florida after a suspension because of gathering too many points on your MVR.

You may already know exceeding beyond the allowable points total in the state of FL can get your license suspended. According to the The FL Department of Highway and Safety and Motor Vehicles (HSMV) there is a thirty day suspension for twelve points accumulated within 1 year.

Florida law demands motorists to hold Bodily Injury Liability (BIL) insurance along with Personal Injury Protection (PIP) and Property Damage Liability (PDL) coverages in some instances, such as when the motorist is found guilty of certain traffic infractions.

If you don’t have insurance to abide by the Financial Responsibility Law during the time exceeding beyond the points total, your driver license it will result to license suspension for up to three years. You will also need to pay a reinstatement fee of $15. Aside from that, you will need to show proof of liability insurance in the form of SR22. You need to carry SR22 car insurance for a period of 3 years to get your drivers license back.

According to SR22 Laws you have to keep file the SR22 with the state for a period of three years if you didn’t have Bodily Injury Liability as well as the state minimum requirements of PIP and PDL included in your auto insurance policy during the time which your points total surpass the amount permitted by law. To learn for sure the amount in your specific situation and if a SR-22 will be necessary to restore your license by the end of the one month suspension, consult the FL HSMV.

Reader’s Question:

I had been found guilty of DUI a couple of months ago and my new automobile insurance firm has stated absolutely nothing regarding a SR-22. I’ve always got full coverage on my automobile and wanted to ask whether you believe the SR-22 in Florida is necessary or not.

Mike

Cape Coral FL

An automobile insurance provider isn’t the one which requires an SR-22 to be maintained, it’s mandated by the courts or a state agency typically following specific traffic infraction such as DUI. State laws vary so it depends upon the state where you had been found guilty of a DUI if they require an SR22 to have your license reinstated or for some other reasons.

If you need to maintain an SR-22 in Florida then you need to be informed. When you have recently relocated or believe you might have overlooked this notification, you need to get hold of your local Department of Motor Vehicles to determine for sure if the financial responsibility certificate is required of you.

Since your DUI occured in Florida, if that is the situation, here’s more info on Florida’s financial responsibility law. According to The Florida Driver’s Handbook, this Financial Responsibility law requires motorists to hold bodily injury liability (BIL) insurance as well as the mandatory PIP and PDL coverages should they have been convicted of certain traffic infractions, which includes DUI or DWI.

If you also you don’t have car insurance to abide by the Financial Responsibility Law, your driver license will be suspended for 3 years. You will need to pay a $15 reinstatement fee and present the department  proof of financial responsibility or SR-22 in Florida for 3 years from the date of the suspension to have your license reinstated.

Reader’s Question:

I am planning to buy a motorcycle next month. I currently have an SR22 Florida insurance and I would like to know if I will be needing an additional insurance for the bike. Do I get a coverage for my bike with my SR22?

Jim

Miami FL
In case you have a non owners SR-22 Florida insurance and you have a motorcycle then its not necessary to get coverage on the bike unless of course you do not satisfy the other motorcycle insurance requirements such as:

1. Should put on head gear and;

2. Should be 21 years old and above

A motorbike insurance plan will have to be separate from your SR22 Florida automobile insurance policy. Additionally, when you have a lien holder on the motorcycle they might demand that you have comprehensive and collision coverage on your policy.

The simplest way to bring down your Motorcycle Insurance is to find car insurance companies and get a quote. To get quotes easily, you should get multiple quotes from comparison website where you will be given multiple quotes from different insurance companies. Reader’s Question:

I was required to file and get an SR22 due to having too many points in my driving record. How long do I need to keep filing an SR22? Is it for one or three years?

Jane

Miami FL

In Florida, if you exceed the allowable points total, your license will be suspended. The Florida Department of Highway and Safety and Motor Vehicles (HSMV) lists a thirty day suspension for 12 points earned within a year, 3 month suspension for eighteen points earned in eighteen months and a one year suspension for twenty four points within a thirty five month period.

Florida law mandates motorists to carry bodily injury liability (BIL) insurance plus PIP and PDL coverages in some cases, when a motorist is convicted of serious violations. According to the Florida Driver’s Manual the Florida Financial Responsibility Law requires an individual to have bodily injury liability insurance at the time of getting a license suspension for getting too many points in their driver license.

If you fail to comply with the Florida Financial Responsibility Law your driver license and/or license plate will be suspended for up to three years. In addition, you will also need to pay a $15 reinstatement fee and provide proof of full liability insurance or Form SR-22 to the DMV for three years to have your license reinstated.

According to the Florida Driver Handbook you will need to continue to file the SR22 insurance with the state for three years. Your situation may be different so it is best to check with the FL HSMV to know for sure how long you need to carry your SR-22.
