In Florida, if you exceed the allowable points total, your license will be suspended. The Florida Department of Highway and Safety and Motor Vehicles (HSMV) lists a thirty day suspension for 12 points earned within a year, 3 month suspension for eighteen points earned in eighteen months and a one year suspension for twenty four points within a thirty five month period.

Florida law mandates motorists to carry bodily injury liability (BIL) insurance plus PIP and PDL coverages in some cases, when a motorist is convicted of serious violations. According to the Florida Driver’s Manual the Florida Financial Responsibility Law requires an individual to have bodily injury liability insurance at the time of getting a license suspension for getting too many points in their driver license.

If you fail to comply with the Florida Financial Responsibility Law your driver license and/or license plate will be suspended for up to three years. In addition, you will also need to pay a $15 reinstatement fee and provide proof of full liability insurance or Form SR-22 to the DMV for three years to have your license reinstated.

According to the Florida Driver Handbook you will need to continue to file the SR22 insurance with the state for three years. Your situation may be different so it is best to check with the FL HSMV to know for sure how long you need to carry your SR-22.

According to the Florida Responsibility Law in the state of Florida, an individual is required to have bodily injury liability insurance if:

  • An accident occured that caused injuries and you where found at fault
  • Drivers license suspension due to getting to many points in your record
  • DUI conviction that resulted in drivers license revocation
  • Habitual traffic offender that resulted in drivers license suspension or revocation
  • drivers license revocation for any serious offense

If you get involved in any of the offense above and you do not have the required liability insurance required by the state of Florida, it will result to drivers license suspension for three years.

To be able to have your driver slicense reinstated, you will have to do the following:

1. pay $15 fee
2. provide proof of financial responsibility certificate or sr22 insurance

To verify this, you may contact the Florida Department of Highway Safety and Motor Vehicle and ask them the time period you will be required to get sr22.

The state of Florida has financial responsibility law that requires all drivers and owners of vehicles to be financially ready if they get involved in vehicular accidents and caused damage or injury to another party.

This law mandates every driver to have liability insurance in an event of:

  • An at fault vehicular accident
  • Getting several points against your driver licenses that resulted to license suspension
  • A license revocation because of a Drinking Under the Influence (DUI) citation
  • A license revocation for being a habitual traffic violator
  • A license revocation because of a serious traffic offense according to the FL Department of Motor Vehicles.

If a driver is involved in any of the mentioned offense and have at that time no car insurance coverage, then his or her driving privileges will be suspended for a period of three years.

I’m guessing that your friend’s license is suspended and for him to have his license reinstated he needs SR22 insurance in Florida, right?

In general, a driver whose license is suspended by the FL Department of Motor Vehicles (DMV) needs to have SR22 insurance in Florida to have his or her license reinstated. In most cases, the need for SR22 insurance is because of any of the following:

  • Drinking under the influence conviction (DUI)
  • Moving violations made in a period of one year, more than what the law allowed
  • Suspension because of unpaid fines
  • Being involved in accident where the driver does not have car insurance
  • Failure in meeting the FL DMV regulations

However, there may still be other violations that your friend may have done that resulted why he needs SR22 insurance.

The SR22 insurance is simply a document showing proof of auto insurance coverage. This document is given by an auto insurance company and needs to be submitted to the Florida Department of Motor Vehicles. And to get SR22 insurance, your friend needs to get first a car insurance policy from a licensed insurer in the states of Florida before she will be given the insurance document in the form of SR22 insurance.

I typically borrow my sister’s car but sometimes I drive it around here at Jacksonville, Florida without her knowledge. I’m not insured but I know that my sister is. I’m wondering if it’s okay to just get her insurance whenever I use her car.

Hey Anne! When you said “get her insurance,” does this mean that you plan to use your sister’s insurance to cover you in case you mess up? (It seems like you plan to use your sister’s car secretly more frequently that’s why you’re interested to know about this) You know what? You will never be covered by your sister’s auto insurance policy for the simple reason that it is under her name and not under yours. Even if you are using her car and her car is listed in her insurance policy, if you create damage to another person or vehicle, you would have to be liable for those damages because you caused them. Your sister will not have anything to do with the incident and in case there is a lawsuit, it is you who would have to face that and not her. It would be much easier to handle if you have your own insurance policy because you will be represented by your insurance company in case of an ensuing trial. So if I were you, I’d get myself an auto insurance policy (This was what I was also told because I love stealing my brother’s car on a Friday nights, too!) Since you are driving your sister’s car there at Jacksonville, FL without explicit permission from her, the least you could do, in case you get caught is, to tell her that you have an auto insurance policy. You may ask your parents to get you covered under their auto insurance policies. Otherwise, talk to your insurance agent and ask for the best insurance plan for you.

If you are past the ten day law on registering a vehicle and the state finds out about it there could be some fees added to the car registration cost.
